AGREEMENT: I, Kim Schmehling, Owner, and Guest agree as follows: Above Guest is an adult and will be an occupant of the unit during the entire reserved period. Other occupants will be family members, friends or responsible adults. Guest agrees to take ordinary and customary good care of the property, its furnishings, contents and equipment and to be responsible for any damage done in or around the house, to any contents including breakage or removal by guest or any member of guest’s party. Guest will not re-arrange furniture of any rooms. No keys will be issued to anyone who is not an adult.
1.Check in time is 3:00 PM. EARLY CHECK IN TIMES ARE ALLOWED ONLY WHEN THE PROPERTY IS CLEANED AND READY FOR OCCUPANCY AND PRIOR APPROVAL IS REQUIRED. Keys will be ready for pick up at property location. Keys WILL NOT be issued with a balance owing or without a signed rental agreement in the owner, or owner's representative’s possession.
2. Check out time is 11:00 AM. THERE MAY BE AN EXTRA CHARGE FOR LATE CHECK OUT AND PRIOR APPROVAL IS NEEDED.A $25 hour fee may be charged for each hour (or portion thereof) past the required check out time due to additional maid services beyond the normal turn-around time. Please leave all keys and remote controls. A $25 per item fee will be charged for each lost key and remote.
3. CLEANING / MAID SERVICE: Each property will be inspected, inventoried and cleaned before your arrival. The rental fee provides for mid-week maid service with linen/towel service and general tidy so that you can enjoy your vacation up to the last moment. Guest agrees to leave the property in the same condition as it was received.
4. WHAT WE SUPPLY: The property is equipped and set up as a fully furnished property that will include bedspreads, linens, blankets, pillows, towels, as well as a fully equipped kitchen. THERE WILL BE EXTRA CHARGES TO YOUR SECURITY DEPOSIT FOR REPLACING THESE ITEMS IF FOUND TO BE NECESSARY.
5. WHAT YOU SHOULD BRING: Plan on packing your personal toiletry items. Since we provide only a limited supply of toilet paper, paper towels, and other dispensable items to get you started on your first day of vacation. You should plan on making a trip to the grocery store to replenish these items as you need them.
6. GUEST LIABILITY: Guest agrees to accept liability for any damages caused to the property (other than normal wear and tear) by guest’s family members, friends or responsible adults, including, but not limited to, landscaping, misuse of appliances, and/or equipment furnished. If damages are in excess of the security deposit being held, Guest agrees to reimburse Owner for costs incurred to repair/replace damaged items.
7. SLEEPING CAPACITY/DISTURBANCES: Guest and all other occupants will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following: A.) Occupancy exceeding the sleeping capacity stated on the reservation confirmation. B.) Using the premises for house parties or any illegal activity including, but not limited to, the possession, serving or consumption of alcoholic beverages by or to persons less than 21 years of age. C.) Causing damage to the premises rented or to any of the neighboring properties. D.) Any other acts, excessive noise or nuisances which interfere with neighbors' right to quiet enjoyment of their property.
8. HOLD HARMLESS: Owner does not assume any liability for loss, damage or injury to persons or their personal property. Neither does the Owner accept liability for any inconvenience arising from any temporary defects or stoppage in supply of water, electricity or plumbing. Nor will Owner accept liability for any loss or damage caused by weather conditions, natural disasters, acts of God, or other reasons beyond its control. In case the house should be damaged due to a hurricane/tropical storm prior to arrival, and therefore not be useable to its full capacity, the full deposit will be returned. After arrival no refunds will be given unless the National Weather Service orders mandatory evacuations for a "Tropical Storm/Hurricane Warning" issued for the islands of Eleuthra /Harbour Island. Repairs will be made within a reasonable time frame. Owner, owner’s representatives or repairmen may enter premises for any purpose connected with the repair, care and management of premises.
9. ADDITIONAL TERMS AND CONDITIONS: The undersigned, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Owner from any and all claims, demands and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result of, or in connection with the occupancy of the premises and agrees to hold Owner free and harmless.
10. NO PETS OR SMOKING ALLOWED.
11. PAYMENT BY CHECK: Guest must pay by Personal Check or Bank Draft in U.S. Funds Only. If a check is returned for NSF there will be a $50 service charge. Keys will not be issued until the check has successfully cleared the bank. Checks should be made payable to Kim Schmehling.
12. SECURITY DEPOSIT: The security deposit is $500 for each villa or $1000 for the entire house. The security deposit is due WITHIN 60 DAYS of your arrival. Your security deposit is fully refundable within 14 days from the checkout date provided that real and personal property are in the same condition as when occupancy commenced and all terms of this agreement are met.
